Georgina Bryant and Rob Davenport in our Corporate + Commercial team recently advised a client with a number of existing nursery settings on their purchase of a further nursery in Sussex.

The purchase

The purchase was a rare opportunity for our client to secure a nursery setting in a valuable location for them, near the South Downs.

The day nursery opened in February 2008 under the ownership of a mother and daughter. Before our team’s involvement, the owners had already informed staff and parents that the nursery would need to close due to unforeseen circumstances unless a buyer could be found and a sale agreed upon in a short timeframe.

How we helped

Our expert nursery solicitors drafted the purchase documentation and, in partnership with Tom Humphries in our Commercial Property team, advised on the lease arrangements so that the purchase was able to complete in a four-week timeframe over August. This short timeframe enabled our client to retain as many parents as possible, securing the business opportunity for them as new owners and ensuring continuity of care for the children at the nursery.
