Selected for redundancy
Our client came to our employment lawyers after being selected for redundancy and offered a settlement agreement to ‘go quietly’. Natalie Pring in our Employment team met with her to review the settlement agreement and find out more about the circumstances leading to her redundancy.
Our client felt that her employer had chosen her for redundancy due to her autism. Although this didn’t lead to a separate disability discrimination claim, it was taken into consideration when negotiating a better settlement agreement.
Negotiating a better settlement agreement
After discussing our client’s situation and reviewing her employment contract, Natalie began negotiations with the employer.
It came to light that our client’s employer had positioned her expertise as more senior than her job title reflected, despite her not being promoted and benefiting from such a promotion (although she had been working towards this).
After gathering the facts, Natalie presented the employer with the following amendments to the settlement agreement:
- An increased termination payment because our client had brought more money into the company (due to her expertise being positioned as more senior than her title).
- An increased ex gratia payment as a gesture of goodwill.
The employer accepted the amendments, and both parties signed the settlement agreement. Our client parted ways with her employer on good terms and was able to take the time to find new employment without struggling financially.
