Case study: over £17,500 for motorcyclist injured by driver who turned into bus lane

Our specialist motorcycle accident solicitors helped a motorcyclist claim compensation for injuries he sustained after colliding with a car.

Background: car turns into biker’s path

Our client, Mr D, was riding his motorcycle and correctly using the bus lane to filter past traffic. The Defendant (car driver) turned left into a side road without checking for traffic in the bus lane and collided with Mr D.

As a result of the accident, Mr D sustained several injuries, including:

  • A soft tissue injury to his left ankle
  • Deep bruising to his left thigh
  • Soft tissue injury to his shoulder
  • Aggravation of his pre-existing knee injury

Claiming compensation for personal injury

Mr D instructed our personal injury solicitors to claim compensation for his injuries. We notified the Defendant’s insurers of the claim, and liability was accepted.

Medical reports obtained to support the claim

Our lawyers obtained copies of Mr D’s medical records and reports from a Consultant Trauma and Orthopaedic Surgeon to comment on his physical injuries caused by the accident.

The report confirmed that Mr D’s soft tissue injuries to his left thigh, knee and ankle all resolved within three to four months of the accident; however, Mr D was still experiencing ongoing symptoms in his shoulder and remained affected psychologically.

MRI scan required

The surgeon requested that Mr D have an MRI scan of his shoulder before commenting on the extent of the injury. This was arranged by our solicitors.

Following the results from the MRI scan, the surgeon suggested Mr D’s shoulder condition likely pre-dated the accident but was triggered, i.e. became symptomatic, as a result of the collision. He recommended an ultrasound-guided injection, followed by a course of physiotherapy, which was also arranged by our team on a deferred payment basis.

Psychologist’s report confirms travel anxiety

A further report from a Psychologist confirmed that our client suffered a specific travel anxiety when riding his motorcycle after the accident. They recommended six sessions of Cognitive Behavioural Therapy (CBT), which our solicitors arranged on a deferred payment basis. Following the CBT, the Psychologist confirmed Mr D’s anxiety had reduced.

Claim for financial losses

Our personal injury lawyers collated details of Mr D’s financial losses he incurred as a result of the accident. These included medical treatment paid for by our solicitors, which included his MRI scan and CBT treatment.

Negotiating a settlement offer

The Defendant made an offer just above £9,000, which was lower than what our solicitors had valued the claim at. We negotiated an offer of just over £17,500, which Mr D accepted.
