Fatal injury claim after child killed by trailer

Our personal injury solicitors helped a family to seek closure after their young son was fatally injured on a road in Bristol.

A three-year-old boy was sadly killed when a trailer came loose from a car on a residential road and mounted the pavement kerb.

Our fatal injury lawyers represented the boy’s parents in claiming compensation for their loss, separately to the criminal trial involving the driver of the vehicle that took place around the same time.

Proving fault and claiming for fatal injury

Our specialist team sent a letter of claim to the Defendant stating that they had failed to ensure the trailer was adequately and securely connected to the vehicle and had not noticed that the equipment had become loose.

The Defendant’s solicitors advised that they wanted to arrange a meeting with our lawyers and explore an early settlement, which the boy’s mother agreed to.

The driver made an offer of £20,000 for all claims, however, this meant that the parents would not be able to make separate claims, and so the offer was rejected. We recommended that Freddie’s parents make a Part 36 offer, which was accepted.

Settlement

Our personal injury solicitors successfully claimed £17,265.96 for the family.

Although no amount of money could make up for the loss of their child, the compensation helped the family to pay for the child’s funeral and wake.
