Case study: £25,000 for cyclist injured in collision with car

Accident circumstances and injuries sustained
Our client, Miss J, was cycling down the road and approached a junction, indicating she was turning right. She was intending to cross over a lane of traffic to continue her route. A car coming in the opposite direction had come to a stop to let Miss J cycle over the lane and continue her intended route. However, before having the opportunity to do this, another car pulled out of the junction at speed colliding with Miss J.
As a result of the accident, Miss J sustained the following injuries:
- Concussion
- Soft tissue injuries to her neck, back, knees and ankle
- Psychological injury
Claiming compensation for personal injury
Miss J approached our specialist cycling accident solicitors to help her claim compensation for her injuries.
Our team submitted a claim to the Defendant’s (driver) insurer and liability was accepted.
Pre-medical report compensation offer
Following the accident, Miss J’s concussion symptoms showed little improvement and she was being investigated by her doctors for post-concussion symptoms. She was vomiting on a daily basis, had light-headedness, fatigue, memory loss and impacted vision.
Before our solicitors obtained Miss J’s medical reports to support her claim, the Defendant’s insurers made a pre-medical offer of £5,000 and offered to arrange rehabilitation for Miss J. As this was an early offer of settlement, Miss J wanted to see how her injuries progressed before considering settlement. We arranged with the Defendant for her to undertake rehabilitation treatment to help ease her symptoms and assist her recovery. This was funded by the Defendant at no cost to Miss J. An initial assessment was arranged and the rehab expert recommended physiotherapy and further scans. Following the initial assessment report, the Defendant’s made a further early offer of settlement of £20,000. Although Miss J had made a near-full recovery, our solicitors advised Miss J on the risks of accepting the early settlement offer without having obtained medical evidence and information to value the claim, specifically, there was no definitive long-term prognosis.
Medical reports obtained
In support of our client’s claim, our solicitors obtained copies of Miss J’s medical records to assess her symptoms and her recovery.
Claim for financial losses
Our personal injury lawyers collated details of Miss J’s financial losses she incurred as a result of the accident. These included:
- Damage to her bike
- A delayed completion of her PhD and associated costs
Settlement offer
Miss J was keen to consider settling the claim, but wanted to ensure she received fair compensation. Miss J confirmed she would be willing to settle the claim at between £20,000 and £25,000. Our solicitors, negotiated an offer of £25,000 with the Defendant’s insurers which Miss J accepted.
