Trip on unrepaired footpath
Our client, Miss S, was 11 years old at the time of the accident. She was walking along a footpath on her school grounds between classrooms, carrying cooking items and her PE kit in her hands. As she was walking, she tripped on a raised, unrepaired section of the footpath, hitting her face on the ground.
As a result of the fall, Miss S sustained facial injuries, which included a fracture to her jaw and damage to her front teeth.
Claiming compensation for personal injury
Due to Miss S’s age at the time of the accident, her father instructed our specialist teeth damage solicitors to help claim compensation for her injuries. Miss S took over the claim when she was 18.
The school owed our client a duty of care as a pupil of the school under section 2 of the Occupiers’ Liability Act 1957.
We notified the Defendant’s (the school’s) insurers of the claim, outlining details of the accident. Liability was accepted.

Medical reports obtained
We obtained copies of Miss S’ medical records and reports from a Dentist and a Maxillofacial Surgeon to determine the full extent of her injuries.
The reports confirmed:
- Miss S suffered grazes and bruises to her face, damage to her upper left central incisor and chipped teeth.
- Whilst Miss S had made an excellent recovery from her injuries, as she was still young, there were concerns about what future treatment would be required.
- Miss S had regular fillings and she was seen by a Restorative Dentist who recommended a treatment plan.
- Our solicitors secured an interim payment for Miss S to fund the recommended dental treatment.
A further report from the Dentist was obtained when Miss S was older and had undergone the treatment. This confirmed:
- Miss S would require resin restorations every seven to eight years.
- Miss S’s tooth was likely to fall out.
- A replacement of her crown would be required every 15 years.
Claim for financial losses
Our personal injury lawyers collated details of Miss S’s financial losses she incurred as a result of the accident. These included:
- All the dental treatment Miss S had received because of the accident.
- Future dental treatment needs, including the cost of a partial denture if Miss S is to lose the tooth, resin restorations and replacement crowns she will need over her lifetime.
- Loss of earnings: Miss S was unable to work whilst she was undergoing dental treatment and recovering.
Settlement offer
Following settlement negotiations, the claim settled for £47,000.
