Accident circumstances and injuries sustained

Our client, Ms F, was cycling to work. There was queuing traffic along the road and she was correctly positioned on the left-hand side of the vehicles between the kerb and cars. As she was cycling along, a motorcycle suddenly and without warning pulled out from between the cars, trying to undertake the traffic, and collided with Ms F.

Ms F sustained a fracture to her right elbow requiring surgery to insert plates and screws. She was also psychologically impacted by the accident.

Claiming compensation for personal injury

Ms F instructed our specialist cycling accident solicitors to help her claim compensation for her injuries.

We notified the Defendant’s (motorcyclist) insurers of the claim, outlining details of the accident. Liability was accepted.

Medical reports obtained

In support of our client’s claim, our solicitors obtained copies of Ms F’s medical records and instructed a Consultant Orthopaedic Surgeon specialising in upper limb injuries to examine the full extent of her injuries and prepare a report.

Ms F had been undergoing post-operative physiotherapy, but her elbow remained stiff and uncomfortable. The report confirmed that further physiotherapy was required as there was a chance she would require further surgery in the future to help with the stiffness. Ms F continued to seek treatment for her elbow and made significant progress in her recovery, without the need for further surgery. However, evidence suggested our client had a 20% chance of developing post-traumatic arthritis over the next 10 years. If she went on to develop arthritis, there is a 50% chance she would require surgery in the future.

The Surgeon also recommended a further report from a Psychologist to assess her psychological injuries. The Psychologist confirmed that Ms F was suffering from an adjustment disorder with mixed anxiety and depression which would continue to improve over time. As she was making good progress, treatment was not recommended.

Claim for financial losses

Our personal injury solicitors collated details of Ms F’s financial losses she incurred because of the accident. These included:

  • Repair costs to her bike
  • Purchasing a replacement helmet
  • Prescription costs
  • Travel expenses (Ms F used to cycle most places before the accident but had to rely on either family or buses after the accident)
  • Care and assistance provided by her family
  • A non-refundable holiday abroad that she was no longer able to go on

Settlement offer

The Defendant’s insurers made two offers of settlement which were both rejected as our Personal Injury team advised Ms F she would be likely to receive a higher offer.

After a period of negotiation, the claim settled for £30,000 which was £10,000 more than the Defendant’s original offer.
