Case study: £18,000 compensation for stress at work claim

Background
Our client, Ms X, had worked for her employer for over two years. During that time, she was overworked, given additional duties without consultation, given unachievable and unrealistic objectives, and was subject to continuous aggressive behaviour from colleagues in a male-dominated workplace, even after raising concerns with members of HR and her supervisors.
Ms X was placed on sick leave by her GP twice in one year due to stress. She instructed our specialist stress at work solicitors to advise her on making a claim against her employer.
Claiming for stress at work
Our employment lawyers wrote a pre-action letter to Ms X’s employer, outlining the issues she had faced and the potential claims she could pursue which included stress at work, potential constructive dismissal, disability discrimination, and harassment.
Following negotiations, Ms X’s employer agreed to pay £18,000 in compensation and settle the claim with a clean break settlement agreement which she accepted.
A clean break settlement is a legal contract which ends the relationship between you and your employer on jointly agreed terms. As part of this agreement, it is normal for your employer to agree to pay you a sum of money.
Our solicitors then advised Ms X on the terms of the settlement agreement and made beneficial amendments to provide Ms X additional post-termination protection, provide certainty and clarity on unclear terms proposed by the employer, and remove unreasonable clauses, including being prevented from working in the near future.
