Case study: £19,000 compensation for driver hit by motorcycle

Our specialist road traffic accident solicitors helped a man claim compensation for injuries he sustained in a collision with a motorcycle.

Mr H was stationary in his car whilst waiting to enter the roundabout when he was hit in the rear of his vehicle by the Defendant who was on a motorcycle. When our client got out of his car, he was shocked to discover that the motorcyclist was trapped between his motorcycle and our client’s car. The motorcyclist sadly passed away in the ambulance on the way to medical treatment.

Our client sustained injuries to his leg, ankle, back and neck, as well as psychological injury.

Submitting a compensation claim

Mr H instructed us to submit a claim for compensation to the motorcyclist’s insurers, the Defendant, and liability was subsequently admitted.

Our personal injury solicitors proceeded to obtain medical reports for our client’s orthopaedic injuries, the majority of which would fortunately resolve within six months of the accident. However, an MRI was recommended on his neck due to a suspected trapped nerve. Additionally, a referral for a psychological assessment was recommended given what he experienced that day.

Two settlement offers were received by the Defendant, one in the sum of £10,000 which would be withdrawn after 21 days, and a Part 36 offer of £9,000. Our expert Personal Injury team discussed with our client the difference between the offers and the effect these would have on the claim. Mr C decided not to accept either offer at this stage and decided to wait until final medical evidence was received. Our solicitors supported him with this decision.

The Defendant arranged the MRI scan for our client, which we sent to the Consultant Orthopaedic Surgeon who arranged a re-examination. This report confirmed that our client should undergo a further MRI, specifically of his lumbosacral spine.

We also instructed a Psychiatrist who reported that our client was experiencing Post-Traumatic Stress Disorder (PTSD). We then requested the Defendant arrange the psychiatric treatment as recommended by the Psychiatrist.

Reaching a settlement

In the meantime, the Defendant made an offer of £19,000 to settle the claim. We provided advice to our client based on the medical evidence which we had and he accepted this in full and final settlement of the claim.

Mr H received £19,000 in compensation for the road traffic accident.
