Case study: property co-ownership dispute between family

  • Posted

Our property litigation solicitors advised a couple after a family dispute arose over ownership of a property.

Our clients purchased a property which included large grounds and a bungalow (in addition to the home), and agreed for a family member to live in the bungalow. At the time, they entered into a deed confirming the family member’s right to occupy that bungalow.

Unfortunately, a family dispute arose and our clients wished to terminate the right of occupation relating to the bungalow. Additionally, the family member who occupied the bungalow had a change of circumstance and was unable to consent to the termination of her right. A further dispute arose, with other family members attempting to occupy the bungalow.

Our property litigation lawyers were able to advise our clients on the terms of the deed, the termination of the right to occupy and seeking possession of other occupiers.
