Case study: clarification on lease after unexpected fees

  • Posted

Our property litigation solicitors advised a homeowner after they received demands for service charge payments.

Our client, Mrs N, had purchased a residential flat and had received various demands for payment of a service charge under their lease. The payment was substantial and had come as a surprise to our client.

Our property dispute lawyers were able to advise Mrs N on what fees were payable and when. We were also able to advise our client that some of the higher charges claimed were not payable. This was because the landlord had failed to adopt the correct statutory procedure.

Additionally, we provided Mrs N with an enhanced understanding of their lease and what they should expect in respect of the service charge accounts, including a certified accountant’s report.
